The Magistrate, Dr Marco Guida, after the preliminary hearing related to the above mentioned proceedings, decides that the following people:

VITO CARLO MOCCIA (b. in Milan, 17.11.1952)    -   defaulting

FRANCESCO A. MORELLO (b. in Cantù, 13.2.1949) – defaulting

GABRIELLA FABBRI (b. in Venice, 13.3.1947) – defaulting

ANTONIO TURI (b. in Bari, 1.6.1956)  - defaulting

QUIRINO SALERNO (b. in Benevento, 3.1.1968) -  defaulting

ISA CALABRESE (b. in Carbonara, 13.12.1969) -  defaulting

GRAZIA BOZZO (b. in Genoa, 2.2.1965) -  defaulting

PIERO MAZZA (b. in Bologna, 25.1.1961) -  defaulting

MASSIMO VAVALLE (b. in Noicattaro, 10.10.1968) -  defaulting

FRANCESCO G. LOCATELLI (b. in Orzinuovi, 8.5.1965) -  defaulting

 

are  ALL CHARGED WITH CRIMINAL ASSOCIATION (art. 416, Italian Criminal Code), having all of them – Moccia as the leader and founder of the “Arkeon method”; Turi, Morello, Fabbri, Salerno, Calabrese and Vavalle as promoters – taken part in the organization and running of the Association named “The Sacred Path”, based in Bari, via Amendola 172/C, officially registered since 30.06.2000 and having a steady organization made up of people (the self-proclaimed “Masters”), facilities and considerable funds.

The people mentioned above carried out their activities in the following periods of time:

Calabrese                                  from 1999 to 2008

Ferrara                                    from 2004 to 2007

Mazza                                     from 2002 to 2006

Vavalle                                    from 2006 to 2008

Locatelli                                   from 1999 to 2006

The association branched into other organizations such as:

  • TRIBE HUMAN CONSULTING Ltd, founded on April 23, 2003 by Mr Moccia and Mr Mazza and managed by Mr Vavalle since October 2007;
  • TRIBE COMMUNICATION Ltd, founded on December 2, 2005 by Mr Moccia; on 26.1.2007 Mr Vavalle joined it as a member of the Board of directors;
  • an  ASSOCIATION named “TERRE D’INCONTRO” founded on 23.1.2006 by Mr Moccia, Ms Calabrese and Mr Vavalle;
  • a cultural and amateur sports association, named KI DO KAI, founded on 14.12.2005 by Mr Moccia, Ms Calabrese and Mr Vavalle.

 All these organizations have Mr Moccia as their founder and charismatic leader: he was still the undisputed leader even after resigning, as a result of the legal action against him. All these organizations  were aimed at spreading the “Arkeon method” (as it is also mentioned in the business name of the associations “Terre d’Incontro” and “KI DO KAI”).

The actual activities of these branches were: 1) FRAUD

 

The facts have been proved: these people through trickery and deception

  • boasted about having academic and/or professional qualifications as psychologists and/or “Masters” [ Mr Moccia used to claim he had graduated at Jolla University in San Diego, California and at Fiume University (Degree in Psychology and Education)].  These qualifications are either non-existent or invalid in Italy;
  • made other people – who were going through physical and/or psychological trouble or difficulties (cancer, AIDS, sterility) – believe that they could solve their problems attending the courses of the “Arkeon method” devised by Mr Moccia;
  • put psychological pressure on the weaker spouse, to force him/her to join the groups under the threat of breaking up;
  • tried to convince people who were suffering that the Arkeon method could heal serious illnesses such as cancer or other diseases;
  • tried to convince the sufferer that he/she had been sexually abused in his/her childhood and he/she could get over it by attending the courses.

 

They deceived the followers into paying increasingly larger sums of money for the courses which were structured as follows:

-          level 1, at a cost of Euro 260

-          level 2, at a cost of Euro 750

-          intensive, at a cost of Euro 1100

-          pre-master, at a cost of Euro 900

-          level 3, at a cost of Euro 12000, for those who wanted to become “Masters”

-          courses that were often repeated at a lower price, for a total amount of Euro 20000 per “student”

with the aggravating circumstances of: a) inducing the participants to fear an imaginary danger such as sterility or non-recovery from physical illnesses (cancer, knee injury, etc.) or psychological trouble – being incapable of overcoming the emotional block for having been sexually abused in their childhood by a paedophile (the so-called “theory of the paedophile”) or even having had incestuous relationships with their parents; b) making an unfair profit from the course fees.

In the case in point:

  • P D  paid Euro 15000 for the courses up to June 2003. Mr Morello and Ms Fabbri made her believe that she had been abused by someone when she was a child: they told her that attending the seminars she could find out who the abuser was;
  • G M paid approximately Euro 1500 for various courses in the years 2002-2004. They made her believe that through the energy in her hands she could heal herself and other people from any illness, that she would never be taken ill with cancer; during her first seminar Ms Gabriella Monaco had post-traumatic twitches in her legs after a sort of pranotherapeutic session and during the experiment Mr Morello said to her that she would never have such problems again and he advised her to practice self-healing through the energy of her hands.
  • C C and G M B (a married couple) paid Euro 15000 in 2002: they were persuaded by the “Masters” Turi and Morello that they could finally realize their dream to have a child through the “Arkeon method”. When they decided to give up the courses, Turi threatened them by saying that they would never have any children; Bertucci was even led to believe that he had been abused by a paedophile.
  • S S paid unspecified sums of money; he was led by the Master Ferrara to believe that through the Arkeon courses he could recover from a knee injury; moreover, he was convinced that he had killed his father, and his mother had been his accomplice (June 2005).
  • Y G paid unspecified sums of money; she was led by Morello to believe that following REIKI one could recover from illnesses and even cancer.
  • E A F paid unspecified sums of money; Moccia made her believe that she had been sexually abused in her childhood. Since she didn’t remember that, she was led to think she was protecting the alleged abuser and the perverted side of her mother (“one thing really drove me to despair: Moccia’s emphasizing that a woman who can’t remember being abused, and consequently can’t heal the trauma connected with sexual abuse, leads her children to be abused in the same way”).
  • M S paid unspecified sums of money; in June 2004, during a seminar held in Milan, Moccia led him to believe that both his problems and his sexual orientation had been conditioned by abuse in his childhood.
  • P P paid approximately £ 200000 (the equivalent of Euro 100000); he was led to believe that he had been sexually abused in the past.

With the aggravating circumstance of causing considerable damage to the injured parties.

 

2) ILLEGAL PRACTICE of the profession of Psychologist, Psychotherapist and Physician

    (see item B)

3) LEADING THE PARTICIPANTS TO A STATE OF MENTAL INCAPACITY (see item C)

4) PRIVATE VIOLENCE

Facts already proved against Quirino Salerno:

the crime (art. 81 and 610 of the Italian Criminal Code) of exerting psychological pressure on people under age who weren’t able to express their consent to attend the seminars. More specifically:

  • F C at the age of 10-11 attended a seminar held in Genoa, in 2002, by Quirino Salerno, where she had to be present at a ritual of great emotional impact, during which her mother, Ms S S, insulted and hit her former partner, Mr M M.
  • F E at the age of 17 attended a seminar held in Rubano, in 2003, during which he was forced to listen to the detailed account of his father’s sex life, in front of 60 people.

 

Facts already proved against Francesco Antonio Morello in the places and times mentioned above:

The crime (art. 110 and 610 of the Italian Criminal Code) of exerting violence, during an intensive course named “NO LIMITS”, on Ms G, in front of two unidentified followers of the group. She was immobilized: someone from the back tightened his hold on her arms and her body. This happened in Milan, in January 2003.

 

4) ILL-TREATMENT  TOWARDS PEOPLE UNDER AGE

 

Facts already proved against VITO CARLO MOCCIA:

The crime (art.572 of the Italian Criminal Code) of exerting mind control techniques on a 14-year-old boy, G B, without having any required qualifications (see claim in item B). When G B was only 10-11 years old, he attended 5 seminars achieving “REIKI LEVEL 1”; in the autumn of the year 2003 he attended a seminar held by Moccia himself in a Jolly Hotel near Bologna and was involved in a practice of psychological introspection that led his mother to admit in public playing with his son’s genitals to send him to sleep. After the mother’s public confession, Moccia let the young boy in and invited his mother to apologize to him in public for her morbid behavior. This happened in Bologna, up to the autumn 2003.

 

They organized and held many seminars in various places in Italy leading people who were in trouble, with psychological or physical problems (cancer, AIDS, sterility), and who even thought they had been sexually abused in their childhood (“theory of the paedophile”), to believe they could solve their problems by attending the courses of the “Arkeon method”. These people were forced to attend seminars which were actually only aimed at increasing the number of the participants to make more money. These crimes have been committed in Bari since June 2000 (each for the periods specified above).  

They have been accused of:

  1. the crime (art.81, 110 and 348 of the Italian Criminal Code) of illegal practice of the professions of Psychologist, Psychotherapist and Physician. The people accused didn’t have any of the State qualifications required to practice these professions during the seminars, which they held either on their own or with other people’s complicity. These crimes have been committed in Bari and in other places in Italy since 30 June 2000 (each  for  the  periods  specified  in item A);
  2. the crime (art. 110 and 613 of the Italian Criminal Code) of exerting mind control (with or without hypnosis techniques) over people without their consent, in particular during the seminars named “NO LIMITS”, through the so-called “game of the chairs” and the “lions’ pit”. These activities, carried out by the organizers themselves or with the help and complicity of some of their “colleagues”, almost drove the participants to a state of mental incapacity. These crimes have been committed  in Bari and in other places in Italy since 30 June 2000 (each for the periods specified in item A);
  3. the crime (art. 61 n.7, 81, 110 and 640 c1 and 2 of the Italian Criminal code) of exerting trickery and deception – with or without the complicity of others – in various activities which were all part of the same criminal plan:
  • the people accused boasted about having academic and/or professional qualifications as Psychologists and/or “Masters” [Mr Moccia used to claim he had graduated at Jolla University in San Diego, California and at Fiume University (Degree in Psychology and Education)]. These qualifications are either non-existent or invalid in Italy;
  • made other people – who were going through physical and/or psychological troubles or difficulties (cancer, AIDS, sterility) – believe that they could solve their problems attending the courses of the “Arkeon method” pioneered by Mr Moccia;

In particular VITO CARLO MOCCIA is accused of

G) the crime (art. 368 of the Italian criminal Code) of unfairly reporting for defamation the psychologist Dr Lorita Tinelli, President of the Centre of Studies on Psychological Abuse (Ce.S.A.P), G M and C F to the Public Prosecutor in Bari on March 10, 2006 for what they had said about the Arkeon group during Maurizio Costanzo’s TV programme on Channel 5 (20, 23, 27 January 2006). According to Moccia, Dr Lorita Tinelli, G M and C Fi told lies. On the contrary, investigation proved that they told nothing but the plain truth.

Injured parties: 11 people.

Plaintiffs: 5 people, 2 Associations.

For all the reasons mentioned above, the following people: 1.VITO CARLO MOCCIA, 2.FRANCESCO MORELLO, 3.GABRIELLA FABBRI, 4.ANTONIO TURI, 5.QUIRINO SALERNO, 6. ISA CALABRESE, 7.GRAZIA BOZZO, 8.PIERO MAZZA, 9.MASSIMO VAVALLE, 10. FRANCESCO GIUSEPPE LOCATELLI  are COMMITTED FOR TRIAL.

The hearing will be held on 20 January 2010, at 9 a.m., at the Criminal Section II – Law Court in Bari. If the accused fail to appear before the Court they will be considered as defaulting.

The parties must deliver the relevant papers to the office of the Court at least 7 days before the hearing. This order must be notified to the accused, to the injured parties who were absent at the preliminary hearing, at least 20 days before the date of the trial.
